Terms of Service

These Terms of Service ("Terms") govern your use of the SiteBirds platform, accessible at https://sitebirds.com, and any related services provided by SiteBirds ("we", "us", or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

SiteBirds is an automated website platform designed for businesses. Our platform enables you to create, publish, and manage a professional website — including an integrated AI chatbot, SEO optimisation, and domain registration.

2. Account Registration and Access

To use SiteBirds, you must create an account by providing accurate and complete information, including your name, email address, and business details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old and have full legal capacity to enter into these Terms. If you are registering on behalf of a business, you represent that you have the authority to bind that business to these Terms.

We reserve the right to refuse, suspend, or terminate any account that violates these Terms or that we believe, in our sole discretion, poses a risk to us or to other users.

3. Subscriptions and Payment

SiteBirds is offered on a subscription basis. The following plans are available:

All prices are exclusive of VAT where applicable. Payment is processed via Stripe, our third-party payment processor. By subscribing, you authorise SiteBirds to charge your chosen payment method on a recurring monthly basis until you cancel.

Subscriptions renew automatically at the start of each billing period unless cancelled before the renewal date. We reserve the right to adjust our pricing with at least 30 days' prior notice sent to your registered email address.

4. Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard or by contacting us at hello@sitebirds.com. Cancellation takes effect at the end of the current billing period; your service will remain active until that date.

Refund policy: We do not offer refunds for the current billing period upon cancellation. No partial-month refunds are provided. If you believe an error has occurred, please contact us and we will review your case on an individual basis.

Upon cancellation, your website and associated data will remain available for the remainder of the paid period and will be deleted 30 days after the subscription end date unless you request earlier deletion.

5. Intellectual Property

Your content

Any content you provide to SiteBirds (business name, descriptions, images, contact information, etc.) remains your property. The website content created specifically for your business, based on the information you supply, is owned by you upon creation. You grant SiteBirds a limited, non-exclusive licence to host, display, and serve this content solely for the purpose of providing the service.

SiteBirds platform

All software, algorithms, design systems, templates, code, branding, and other materials that form the SiteBirds platform are the exclusive intellectual property of SiteBirds. Nothing in these Terms grants you any rights in or to the platform itself beyond the right to use it as a subscriber in accordance with these Terms.

6. Use of Artificial Intelligence

SiteBirds uses Claude, an AI model developed by Anthropic, to generate website content, chatbot responses, and other text-based outputs. By using our service, you acknowledge and agree that:

8. Limitation of Liability

To the maximum extent permitted by applicable law, SiteBirds and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from or in connection with your use of or inability to use the service.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total amount paid by you to SiteBirds in the three (3) months immediately preceding the event giving rise to the claim.

The platform is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or completely secure, though we take reasonable steps to ensure reliability and security.

9. Changes to the Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email to your registered address and/or by a prominent notice within the platform, at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, unless mandatory consumer protection laws in your country of residence provide otherwise.
